1-Day Design Intensive Client Agreement 1. Graphic Design AgreementThis Graphic Design Agreement (the “Agreement”) is entered into on the date the initial deposit is submitted by and between you (the “Client”) and Mara Design Co. (the “Designer”), collectively “the Parties.”2. Project DescriptionBy submitting this Agreement, the Designer agrees to spend 8 hours on on design-related assignments to be determined by the Client & Designer together, as well as up to 1 hour of prep work prior to the Intensive, up to 1 hour for a single round of design edits within one week of the Intensive, & a period of 30 days post-project where the Designer agrees to offer email support for questions or concerns about the work we complete together. This support period does not include new design work as this would need to be added on separately.
Work will normally occur between the hours of 8:30am - 5:00pm PT on the Client's specified project date with a 30 minute lunch break, to be confirmed by both parties. This timeframe can be adjusted if agreed upon in writing by both the Client & Designer to adjust for time zone differences.3. Refunds & ReschedulingThis purchase is non-refundable, but may be rescheduled to another date or applied to a different service offering with written notice within 7 days of the scheduled intensive date. If emergent circumstances occur for either Party or require the date to be rescheduled after the 7 day window has passed, the Designer can, at their discretion, schedule a new date with the Client within a 90-day period of the original intensive date. If a new date is not secured within that 90-day period, the deposit will be forfeited & the intensive cancelled.4. PaymentPayment for these services will be to Service Provider at the rate noted and a minimum of one deposit toward the project will be due at the time of booking this project. This can be paid or split into two or three installments, with the first due to reserve your spot & the second automatically withdrawn by the payment processor one month after the initial deposit payment. 5. Additional ExpensesThe Designer agrees to discuss upfront any additional expenses that may be incurred for items such as stock photography, font licensing, plugin licenses, web hosting, or other third party services. These costs are the responsibility of the Client & will be billed separately from the Design Intensive rate.6. OwnershipClient continues to own any and all proprietary information it shares with Designer during the term of this Agreement for the purposes of the Agreement. Designer has no rights to this proprietary information and may not use it except to complete the Graphic Design services. Upon completion of the Agreement, Client will own the final Graphic Design Deliverables.
While Designer will customize Client’s Graphic Design Deliverables to Client’s specifications, Client recognizes that Graphic Designs generally can have a common structure and basis. Designer continues to own any and all baseline template designs it may have created prior to this Agreement. Designer will further own any template designs it may create as a result of this Agreement.
Lastly, Client grants permission for Designer to display the design work created in portfolios or promotional displays showcasing the designer’s work, provided it does not reveal any proprietary or confidential information.7. Entire AgreementThe Parties acknowledge and agree that this Agreement represents the entire agreement between the Parties. In the event that the Parties desire to change, add, or otherwise modify any terms, they shall do so in writing to be signed by both parties.
